The court granted provisional anticipatory bail subject to verification of antecedents and compliance with the conditions under Section 482(2) of the B.N.S.S.

Summary

The petitioner, Chandan Kumar, was implicated in a case alleging the recovery of 235.35 litres of liquor from a vehicle he owned, under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise (Amendment) Act, 2022. He applied for anticipatory bail, asserting a clean antecedent and claiming he was unaware that his driver misused the vehicle. The State opposed the bail, arguing the seriousness of the offence. The High Court, considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 and two sureties, and directed verification of the petitioner’s criminal antecedents. The order was made under Section 482(2) of the B.N.S.S., with a condition that the bail would be confirmed only if the petitioner is found to have a clean record. If any antecedent is discovered, the provisional bail would not be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances.
  • Whether ownership of the vehicle alone suffices to establish culpability under the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the conditions imposed under Section 482(2) of the B.N.S.S. are appropriate for provisional anticipatory bail.
