Bail was granted to the petitioner subject to monetary and surety conditions and mandatory court appearances.
Summary
Aman Kumar, a driver, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly transporting 160 litres of country‑made liquor. The petitioner claimed innocence, stating no incriminating material was found in his possession and that he had no knowledge of the goods. He had been in custody since 16‑10‑2025, had no prior criminal record, and the prosecution had not complied with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed bail, but the court, considering the lack of evidence against the petitioner and the duration of his custody, granted bail on condition of a Rs.15,000 bond with two sureties, one of whom must be a close family member, and mandatory appearance at trial dates. The bail may be cancelled if the petitioner defaults on two consecutive appearances.
Issues considered
- Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act.
- Whether the non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, affects the grant of bail.
- Whether the petitioner poses a risk of fleeing or tampering with evidence.
