BAIL GRANTED

Holding

The court held that bail may be granted in the present case subject to conditions.

Summary

Sonu Kumar Yadav was arrested in connection with a robbery, assault and rioting incident alleged to have occurred on 1 April 2024, where a group of armed men seized wheat, mustard, cash and threatened a woman at gunpoint. He is charged under IPC sections 147, 149, 354, 382 and 387. The petitioner contends he is falsely implicated due to a land dispute, that no incriminating material was recovered from him, and that he has been in custody since 19 April 2025 despite having four prior criminal antecedents. The State opposed the bail application. The Patna High Court, after considering the seriousness of the offences, the period of custody and the petitioner's claim of innocence, granted bail subject to a cash bond of Rs.15,000 with two sureties and conditions of personal appearance, cancelling bail on two consecutive defaults.

Issues considered

  • Whether bail should be granted to an accused charged with offences under IPC sections 147, 149, 354, 382 and 387.
  • Whether the petitioner's claim of false implication and lack of material evidence outweighs the seriousness of the offences and his prior criminal record.

petitioner is innocent and has falsely been implicated in the

present case. No incriminating material has been recovered from

the petitioner also submits that the petitioner has committed no

offence. It is further submitted that there is a land dispute

between the parties due to which the petitioner has been falsely

implicated in this case. The petitioner is in custody since

19.04.2025 and has got four criminal antecedents.
