Patna High Court

Jilajit Kumar @ Jila YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that, despite the serious nature of the charges, bail could be granted subject to a bond and sureties under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Summary

The petitioner, Jilajit Kumar, was charged under Sections 103(1), 61(2), 3(5) of the Bhartiya Nyaya Sanhita and Section 27 of the Arms Act for allegedly abducting and shooting the informant’s son. The petitioner contended that he was falsely implicated, that the informant was not an eye‑witness, and that he himself was injured during the incident. The State opposed the bail application, arguing the seriousness of the offences. The High Court, after considering the nature of the accusations and the length of the petitioner’s custody since 6 April 2025, allowed regular bail. The court ordered release on a bail bond of Rs 10,000 with two sureties, subject to conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Issues considered

  • Whether regular bail can be granted in a case involving murder and arms offences under the Bhartiya Nyaya Sanhita and Arms Act.
  • Whether the allegations constitute a prima facie case sufficient to deny bail.
  • Whether Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023, can be invoked to impose bail conditions.
