Patna High Court

Chaneswar Nut @ Chandeshwari Nut @ Chandeshwar NutversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to regular bail upon furnishing a bond of Rs.25,000 with two sureties.

Summary

The petitioner, Chaneswar Nut, was charged under several serious IPC offences (sections 147, 149, 341, 323, 337, 307, 353, 504, 506) and Section 45 of the Bihar Prohibition and Excise (Amendment) Act, 2016, for allegedly participating in a stone‑throwing mob that assaulted police. He contended that he was falsely implicated, that no specific allegation linked him to the assault on police, and that he had been in custody since 19‑Nov‑2025 despite having eight prior cases. The State opposed regular bail. After hearing both sides, the court concluded that the petitioner was eligible for bail and ordered his release upon furnishing a bail bond of Rs.25,000 with two sureties, subject to the trial court’s satisfaction.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the gravity of the charges under the IPC and the Bihar Prohibition Act
  • Whether the lack of a specific allegation of assaulting police personnel bars the grant of bail
  • Whether the petitioner’s antecedent criminal cases affect his bail eligibility
