Patna High Court

Dharmatma Das @ Dhrm Atma DasversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted to the petitioner.

Summary

Dharmatma Das was arrested in connection with a case alleging that he, along with co‑accused, forced the informant’s brother to commit suicide and then concealed the body. The petitioner contended that the allegations of an illicit relationship and his involvement were false, that he had no specific overt act attributed to him, and that he had no prior criminal record. He had been in custody since 15 June 2025. The State opposed his bail, citing the seriousness of the offences under Sections 108, 238 and 61(2) of the Bharatiya Nyaya Sanhita, 2023. After considering the lack of specific evidence against him and the period of custody already served, the Court granted bail on condition of a Rs.15,000 bond with two sureties.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the offences under the Bharatiya Nyaya Sanhita, 2023.
  • Whether the allegations against the petitioner constitute sufficient ground to deny bail.
