Patna High Court

Vivek KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, subject to a bond of Rs 10,000 and two sureties, without prejudice to the trial.

Summary

Vivek Kumar was arrested in connection with a case registered under Sections 115(2), 126(2), 75(2), 76 and 78(2) of the Bharatiya Nyaya Sanhita for alleged molestation of a victim. The petitioner contended that he was falsely implicated, claiming the complaint arose from a trivial dispute over grazing rights with the informant. He had been in custody since 22 October 2025 and applied for regular bail. The State opposed the bail application, arguing the seriousness of the offences. After hearing both sides, the Court ordered his release on bail upon furnishing a bond of Rs 10,000 with two sureties of the same amount, while expressly limiting the order to bail and not expressing any view on the merits of the case.

Issues considered

  • Whether bail should be granted in a case involving alleged molestation under the specified sections of the Bharatiya Nyaya Sanhita
  • Whether the petitioner poses a risk of fleeing, tampering with evidence, or influencing witnesses
  • Whether the alleged false implication and the nature of the dispute justify bail
