The Court granted bail to the petitioner subject to a bond of Rs.15,000 with two sureties and conditions of appearance.
Summary
The petitioner, Bhagya Narayan Sahni, applied for bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of 441 litres of liquor recovered from a motorcycle and bicycles. The prosecution alleged his involvement, while the petitioner claimed innocence, stating no incriminating material was found on him and that he had no connection with the vehicles. He had been in custody since 22‑11‑2025 and possessed five prior criminal antecedents, with no compliance of Section 103 of the BNSS, 2023. The State opposed bail, but the Court, considering the facts, period of custody, and the bail already granted to a co‑accused, decided to grant bail subject to a bond of Rs.15,000 with two sureties and specific conditions. The order directed the petitioner to appear at every trial date and allowed cancellation of bail on default.

- Whether bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act considering the nature of the offence and his antecedents
