Patna High Court

Chooha @ Raushan Kumar @ ChuhaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner.

Summary

The petitioner, Chooha (also known as Raushan Kumar), was arrested for allegedly snatching a mobile phone on 08.05.2025, leading to charges under Sections 304(2) and 317(2) of the Bharatiya Nyaya Sanhita, 2023. He applied for bail, contending that he was falsely implicated, that the search and seizure memo lacked independent witnesses, and that the allegations were general and omnibus. The State opposed the bail, emphasizing the petitioner’s custody since 09.05.2025 and his three prior criminal antecedents. The court examined the facts, the nature of the offences, and the period of custody, and found no compelling reason to deny bail. Consequently, the court ordered the petitioner’s release on bail upon furnishing a bond of Rs. 15,000 with two sureties of the same amount.

Issues considered

  • Whether the petitioner is entitled to bail for offences under Sections 304(2) and 317(2) of the Bharatiya Nyaya Sanhita, 2023 given the circumstances of arrest and prior antecedents
  • Whether the prosecution’s evidence and allegations justify denial of bail
