Patna High Court

Ajit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted as the investigation produced no prima facie evidence against the petitioner, and the only basis for suspicion was the co‑accused’s disclosure.

Summary

The petitioner, Ajit Kumar, was named in an FIR for alleged cyber fraud under several provisions of the Bhartiya Nyay Sanhita, 2023 and the Information Technology Act, 2000. The prosecution’s case rests mainly on a disclosure by a co‑accused, with no electronic trail or other incriminating material found against the petitioner. The petitioner’s counsel argued that, apart from this suspicion, the investigation revealed no prima facie evidence. The State opposed bail, citing the seriousness of the offences. The court, noting the lack of substantive evidence and the reliance on mere suspicion, ordered the petitioner’s release on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the BNS.

Issues considered

  • What is the appropriate basis for granting bail when the investigation yields no incriminating electronic evidence against the accused?
  • Whether the suspicion arising solely from a co‑accused’s disclosure suffices to deny bail under the provisions of the Bhartiya Nyay Sanhita and the Cr.P.C.
