Holding

The Court granted provisional anticipatory bail to the petitioner, subject to verification of her criminal antecedents and compliance with bail conditions.

Summary

The petitioner, Koyali Devi, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly possessing six litres of liquor recovered from a straw house on her premises. She argued that the liquor was not in her conscious possession, the straw house is accessible to villagers, and that an adversary may have planted the liquor to implicate her family. The petitioner also highlighted that she has only one prior case under the Excise Act and is a woman, seeking protection from arrest. The State opposed the grant of anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.5,000 with two sureties and directed verification of her criminal antecedents. It further stipulated that if more than one prior case is found, the bail would not be confirmed, whereas confirmation would follow if only one prior case is verified.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the circumstances of the alleged offence under Section 30(a) of the Bihar Prohibition and Excise Act.

straw house of the petitioner with an intent to implicate the

entire family members. It is also submitted that it does not
