BAIL GRANTED

Holding

The Court granted bail to both petitioners subject to monetary bond and conditions of appearance.

Summary

The petitioners, Santosh Kumar and Prince Kumar, were arrested in connection with an Excise case (No. 464 of 2025) for alleged possession of 270 litres of Nepali liquor, alleged under Section 30(a) of the Bihar Prohibition and Excise Act. They claimed they were merely the driver and passenger of the vehicle and had no knowledge of the illicit liquor, asserting innocence and lack of any incriminating material in their possession. The prosecution opposed bail, while the petitioners highlighted the absence of compliance with Section 103 of the BNSS, 2023 and their clean criminal record. The Court, after considering the facts, the period of custody since 28‑11‑2025, and the lack of direct evidence against them, decided to grant bail. Both petitioners were ordered to be released on bail upon furnishing bonds of Rs.15,000 each with two sureties, subject to conditions of family surety and regular appearance in court.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act in the present circumstances.
  • Whether the prosecution has complied with the procedural requirements of Section 103 of the BNSS, 2023.
