Holding
The court held that bail could not be granted and dismissed the bail application.
Summary
Shambhu Rai, the petitioner, was charged with multiple offences under the Indian Penal Code, including murder (Section 302) and various assault and robbery provisions. He applied for bail, claiming a clean antecedent and alleging false implication by the informant. The informant alleged that Rai and others assaulted her and her father‑in‑law, resulting in the latter's death. The State and the informant opposed bail, emphasizing the seriousness of the charges, especially the alleged fatal assault. After hearing both sides, the court found the allegations sufficient to deny bail and rejected the petitioner's application.
Issues considered
- Whether bail should be granted to an accused facing murder and other serious IPC offences.
- Whether the allegations of assault leading to death justify denial of bail.
- Whether the petitioner's clean antecedent and claim of false implication affect the bail decision.

informant by rod causing injury.
4. Learned counsel for the petitioner submits that
petitioner has been falsely implicated in the instant case by the
informant. It is next submitted that the date of occurrence is
05.08.2023 and the fardbayan of the informant was recorded at

and the father-in-law of the informant during the course of
treatment also died.
