The court granted bail to the petitioner.

Summary

Sachin Kumar applied for bail in a case registered under Sections 303(2), 317(2) and 3(5) of the B.N.S., 2023 concerning a stolen bike. The prosecution alleged that the informant’s bike was stolen by unknown persons, while the petitioner’s counsel argued that he was not named in the FIR, had no criminal antecedent, and that the recovery was made from three other persons, not from him. The counsel also highlighted an 11‑day delay in lodging the FIR and pointed out that a co‑accused had already been granted bail in a similar case. The State opposed the bail application. After hearing both sides, the court found the petitioner’s arguments persuasive and ordered his release on bail upon furnishing a Rs.10,000 bond with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner given the alleged offences under the B.N.S., 2023 and the circumstances of the investigation.
