The Court granted anticipatory bail to the petitioner subject to the stipulated conditions.
Summary
The petitioner, Dhurendra Rai, sought anticipatory bail fearing arrest in a case (Bairgania PS Case No. 210 of 2025) under Section 30(a) of the Bihar Prohibition and Excise Act, where 790.8 litres of liquor were seized. The prosecution alleged involvement, but the petitioner’s counsel argued that no liquor was found in his possession, he was neither the owner nor driver of the vehicle, and he has no criminal record. The counsel also contended that the statutory requirement of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, was not complied with. The State opposed the bail. The Court, after considering the facts, granted anticipatory bail on the condition that the petitioner surrenders within six weeks, furnishes a bail bond of Rs. 15,000 with two sureties, and complies with conditions under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under the circumstances.
- Whether the prosecution has made a case against the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act.
- Whether the requirements of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, have been complied with.
- Whether Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023, permits the grant of anticipatory bail.
