The Court granted anticipatory bail to the petitioner subject to the stipulated conditions.
Summary
The petitioner, Sintu Kumar, sought anticipatory bail fearing arrest in a case (Hisua P.S. Case No. 367 of 2025) under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of 234 litres of liquor recovered from a tempo and a motorcycle. The prosecution alleged the liquor recovery, while the petitioner contended he was neither the owner nor the driver of the vehicles and had no criminal antecedent. His counsel argued that no prima facie case existed and that Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, had not been complied with. The State opposed the bail. The Court, after considering the facts, granted anticipatory bail on the condition that the petitioner surrenders within six weeks, furnishes a bail bond of Rs. 15,000 with two sureties of equal amount, and complies with Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under the circumstances.
- Whether there is a prima facie case against the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act.
- Whether the requirements of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, have been complied with.
- Whether Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023, permits the grant of anticipatory bail.
