Patna High Court

Abhishek SahversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

The petitioner, Abhishek Sah, was arrested in a murder case under Sections 103(1), 238, 61(2) and 3(5) of the B.N.S., 2023, where the FIR alleged that he and others killed his brother and sister‑in‑law. The informant who lodged the FIR was not an eye‑witness and later, as a witness, denied naming the petitioner or knowing the assailants. The petitioner argued that he is innocent, has no prior criminal record, and that co‑accused have already been granted bail. The State opposed bail, citing the seriousness of the offences. Considering the informant’s lack of credibility, the petitioner’s clean antecedents, and the precedent of bail to co‑accused, the Court allowed the bail application, ordering release on a bail bond of Rs. 10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner under the offences charged under the B.N.S., 2023
  • Whether the informant’s testimony and lack of prior criminal record justify bail
