Deepak Kumar @ Deepak GajeriversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to bail bond, sureties and compliance with Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita.

Summary

The petitioner, Deepak Kumar, was implicated in a case (PS‑306/2025) for alleged possession of 1,350 litres of liquor recovered from six motorcycles, violating Sections 274, 275, 317(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 30(a) of the Bihar Prohibition and Excise Act. He claimed he was merely the registered owner of one motorcycle and had no knowledge of the liquor, arguing that no prima facie case existed and that the prosecution had not complied with Section 103 of the Bharatiya Nagarika Suraksha Sanhita. The State opposed his request for anticipatory bail. The Court, after considering the facts, granted anticipatory bail on the condition that the petitioner surrenders within six weeks, furnishes a bail bond of Rs. 15,000 and two sureties of equal amount, and complies with the conditions under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the Bharatiya Nagarika Suraksha Sanhita.
  • Whether the prosecution has complied with the procedural requirements of Section 103 of the Bharatiya Nagarika Suraksha Sanhita.
  • Whether the petitioner can be held liable for the alleged liquor possession given his claim of lack of knowledge.
