Patna High Court

Mohammad HafizversusThe State of Bihar

Holding

The court allowed the anticipatory bail application, granting provisional bail subject to bond, sureties and verification of antecedents.

Summary

Petitioner Mohammad Hafiz, owner of a Bolero vehicle from which 210 litres of liquor was seized, applied for anticipatory bail under the Bihar Prohibition and Excise Act. He argued that he was not in possession of the liquor, was unaware of its misuse by a driver, and that ownership of the vehicle alone should not make him culpable. The State opposed the bail. The Patna High Court, after hearing counsel, granted provisional anticipatory bail on a bail bond of Rs.5,000 with two sureties, subject to verification of the petitioner’s criminal antecedents under Section 482(2) of the B.N.S.S. If more than one antecedent is found, the bail will not be confirmed; if only one, it will be confirmed. The court also directed the petitioner to deposit Rs.2,500 with the Lawyers’ Association within two weeks.

Issues considered

  • Whether the petitioner is liable to arrest solely on the basis of ownership of the vehicle in which liquor was seized.
  • Whether anticipatory bail should be granted in a case under Sections 30(a), 41(i)(ii) and 47 of the Bihar Prohibition and Excise Act.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.

came to be implicated based on the fact that he is owner of the

seized vehicle. It is next submitted that no prudent person would

use his own vehicle for committing an occurrence and thus,
