Bail was granted to the petitioner subject to bond and conditions.
Summary
The petitioner, Rajesh Sahani, was arrested in connection with the seizure of 211.200 liters of liquor from a hut, alleged to violate Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he had no possession of the liquor, the hut was far from his residence, and his name was supplied by locals rather than by on‑spot arrest. The State opposed bail, while the petitioner highlighted the lack of incriminating material, his custody since 12‑Oct‑2025, and non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The Court examined these facts, the duration of custody, and the petitioner’s prior criminal antecedents, and found no compelling reason to deny bail. Consequently, the Court granted bail on a bond of Rs.15,000 with two sureties and imposed conditions regarding family surety and regular appearance before the trial court.
Issues considered
- Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act
