Ashok Kumar JhaversusThe State of Bihar

Decided

BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioners with specified conditions.

Summary

Petitioners Ashok Kumar Jha and Navin Kumar Jha sought anticipatory bail after a complaint was lodged alleging conspiracy to defraud by selling joint property to each other's wives, and assaulting the complainant, who is their brother. The prosecution charged them under Sections 318(4), 338, 336(3), 340(2) and 61(2) of the Bharatiya Nyaya Sanhita. The petitioners contended that the dispute is civil in nature, that they are innocent, and that similar co‑accused have already been granted anticipatory bail in a related case. The State opposed the bail application. Considering the nature of the allegations, the existence of a parallel civil suit, and the precedent of earlier bail, the Court allowed anticipatory bail subject to a bail bond of Rs.10,000 with two sureties and a requirement to surrender within eight weeks, under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners despite the serious charges under the Bharatiya Nyaya Sanhita.
  • Whether the alleged offences constitute a non‑bailable offence warranting denial of bail.
  • Whether the underlying property dispute being civil in nature affects the grant of anticipatory bail.
