Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioners.

Summary

The petitioners, three women from Muzaffarpur, were arrested in connection with a murder case (Turki PS Case No. 179 of 2024) under Sections 103(1), 238 and 61(2) of the Bharatiya Nyaya Sanhita, 2023. The prosecution alleged that they participated in the killing of an informant’s brother, while the defence contended that the deceased had committed suicide by hanging and that the women were falsely implicated with no specific overt act proved against them. The petitioners highlighted the absence of a suicide note, the post‑mortem report indicating asphyxia, their lack of criminal antecedents, and the fact that a co‑accused had already been granted bail. The State opposed the bail application, arguing the seriousness of the offences. Considering the lack of material evidence, the prolonged custody since 16‑10‑2025, and the petitioners’ personal circumstances, the Court inclined to grant bail, ordering them to furnish bail bonds of Rs.10,000 each with two sureties.

Issues considered

  • Whether bail should be granted to the accused under Sections 103(1), 238 and 61(2) of the Bharatiya Nyaya Sanhita in view of the alleged murder and the circumstances of the case.
