Patna High Court

Nandlal DhangarversusThe State of Bihar

Decided

DISPOSED

Holding

The court granted provisional anticipatory bail subject to verification of the petitioner’s antecedent and compliance with the stipulated bond and surety conditions.

Summary

The petitioner, Nandlal Dhangar, sought anticipatory bail fearing arrest under Sections 30(a) and 41(i) of the Bihar Excise Act for alleged possession of liquor recovered from his house and a nearby bush. He argued that the liquor was not found in his conscious possession, the house is joint family property, and the 2018 amendment to the Excise Act abolished the doctrine of deemed possession. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.15,000 with two sureties and directed verification of the petitioner’s criminal antecedent. If the petitioner is found to have more than three prior excise cases, the bail will not be confirmed; otherwise, it will be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted in a case under Sections 30(a) and 41(i) of the Bihar Excise Act where alleged possession is not in conscious possession.
  • Effect of the 2018 amendment removing the concept of deemed possession on the bail application.
  • Whether the petitioner’s prior criminal antecedent (three cases) influences the grant of anticipatory bail.

                                2. The petitioner apprehends his arrest in a case

registered for the offences punishable under Sections 30(a) and

                                3. Learned counsel for the petitioner submits that

petitioner has antecedent of three cases under the excise act and

allegation is of recovery of 10 liters of liquor from house of the

with certainty that it was petitioner who had kept the liquor in

the house or the liquor kept in the house was within his

knowledge and after amendment in the excise act in the year

has been done away with. It is next submitted that he came to be

implicated based on secret information which is the easiest way

to implicate someone without holding a proper investigation.

                       5. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

                       6. Considering the submissions made by the learned

than three cases then it would be presumed that petitioner, for

the purposes of seeking anticipatory bail, had concealed his
