Holding
Anticipatory bail was denied because of the serious nature of the allegations and the petitioner’s prior similar criminal antecedent.
Summary
Petitioner Rajesh Rai sought anticipatory bail after an FIR alleged that he, along with co‑accused, fired indiscriminately from a pistol at an informant’s house and attempted to abduct her. The FIR also noted two prior criminal records for the petitioner, one of a similar nature. The petitioner feared arrest under Sections 126(2), 115(2), 109, 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act. The Court examined the seriousness of the alleged offences and the petitioner’s criminal antecedents. Considering the gravity of the accusations and the prior similar conviction, the Court refused the prayer for anticipatory bail. The petition for anticipatory bail was therefore dismissed.
