Shanti Devi @ Shanti KuwarversusThe State of Bihar

The Court granted provisional anticipatory bail subject to verification of the petitioner’s antecedents, with confirmation contingent on the finding that she has no more than two prior excise cases.

Summary

Shanti Devi, a woman with two prior excise cases, feared arrest after an FIR was lodged under Section 30(a) of the Bihar Prohibition and Excise Act for the alleged recovery of 270 litres of liquor from a bush behind her hut. She contended that the liquor was not in her possession, the site did not belong to her, and the complaint was based solely on the testimony of a chowkidar, raising doubts about the investigation. She applied for anticipatory bail, arguing that the police had mechanically implicated her without proper inquiry. The State opposed the bail. The Court granted provisional anticipatory bail conditioned on a bail bond of Rs.10,000 with two sureties and directed the trial court to verify her criminal antecedents; if more than two prior cases are found, the bail would not be confirmed, otherwise it would be confirmed forthwith.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the circumstances of the FIR under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the alleged recovery of liquor from a location not belonging to the petitioner justifies denial of bail.
  • Whether the petitioner’s prior two excise cases affect the grant of anticipatory bail.

that if chowkidar was aware of the involvement of the petitioner

in the occurrence then why he did not inform the police prior to

institution of the instant FIR which casts an aspersion on the

case of the prosecution. It is next submitted that once an accused

is implicated in a case relating to excise, the police starts
