Patna High Court

Pampal PaswanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is to be granted as the petitioners are not specifically implicated in the FIR and have clean antecedents.

Summary

The petitioners, seven individuals named Paswan, sought bail fearing arrest in a case (PS Alamnagar, Case No. 201 of 2025) that alleged offences under multiple sections of the Bhartiya Nyaya Sanhita and the Arms Act. The FIR specifically implicated co‑accused Pintu Mukhiya for firing at an informant, while the petitioners faced only a general, omnibus allegation with no specific overt act attributed to them. The petitioners argued they had clean antecedents and that the prosecution’s case lacked particularized charges against them. The State opposed the bail, contending the seriousness of the offences. The Court, considering the lack of specific allegations against the petitioners and the principle of liberty, ordered that they be released on bail upon furnishing bonds of Rs.10,000 each with two sureties, subject to conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Issues considered

  • Whether bail should be granted to the petitioners despite the pending charges under multiple sections of the Bhartiya Nyaya Sanhita and the Arms Act
  • Whether the FIR contains specific allegations against the petitioners sufficient to deny bail
