Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner.

Summary

The petitioner, Binay Kumar, was arrested after 112.13 litres of liquor were recovered from his residence and charged under Section 30(a) of the Bihar Prohibition and Excise Act. He applied for bail, contending that he was innocent, that the liquor was found in a joint family house, and that no incriminating material was recovered from his personal possession. The petitioner also highlighted his lack of prior criminal record and the alleged non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed the bail application. Considering the facts, the period of custody already served, and the absence of any material linking the petitioner directly to the offence, the Court decided to grant bail on the condition of a Rs. 15,000 bond with two sureties of equal amount.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act in view of the circumstances of the case
  • Whether the non‑compliance of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, affects the bail application
