BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to conditions under Section 482 of the B.N.S.S., 2023.

Summary

The petitioner, Niranjan Prasad Gupta, sought anticipatory bail after learning that he might be arrested in a case registered under Sections 80(1) and 3(5) of the B.N.S. concerning the alleged dowry‑related murder of his daughter‑in‑law. The FIR alleges that the deceased was subjected to cruelty and was eventually killed on 04‑09‑2025, with the primary accusation directed at her husband, who is already in custody. The petitioner contended that he is a separate individual with no involvement in the family affairs or the alleged crime. The State opposed the bail, arguing that the petitioner could be complicit. The Court, after considering the facts, granted anticipatory bail on the condition that the petitioner surrenders within eight weeks and furnishes a bail bond of Rs.10,000 with two sureties, subject to Section 482 of the B.N.S.S., 2023. The order was pronounced by Hon’ble Justice Prabhat Kumar Singh.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under the circumstances of the dowry‑death case
