Anticipatory bail is granted to the petitioner subject to a bail bond and conditions under Section 482 of the B.N.S., 2023.
Summary
The petitioner, Nasroon Khatun, mother‑in‑law of a woman who allegedly died by suicide, sought anticipatory bail fearing arrest in a case registered under Sections 80(2) and 3(5) of the B.N.S., 2023. The prosecution alleged that the deceased was subjected to dowry‑related cruelty and was killed by her husband and co‑accused. The petitioner argued she had no involvement in the family affairs and the allegations were general and omnibus. The court noted the lack of direct evidence linking the petitioner to the alleged crime and the fact that the deceased’s death was a suicide. Consequently, the court granted anticipatory bail, subject to a bond of Rs.10,000 with two sureties and conditions under Section 482 of the B.N.S., 2023.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Sections 80(2) and 3(5) of the B.N.S., 2023.
- Whether the petitioner is likely to be involved in the alleged dowry‑related murder.
