RAMBABU RAI @ RAMBABU RAYversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court grants bail to the petitioner.

Summary

The petitioner, Ramababu Rai, was arrested after 23.04 liters of liquor were recovered from a carton in front of his house, and he was charged under Section 30(a) of the Bihar Prohibition and Excise Act. He applied for bail, claiming innocence, lack of incriminating material in his possession, and that the liquor was in a public open area. He also highlighted his clean criminal record and the alleged non‑compliance of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed the bail. Considering the facts, the period of custody since 08‑12‑2025, and the absence of any material linking the petitioner directly to the offence, the Court inclined to grant bail. The Court ordered his release on bail upon furnishing a bond of Rs. 15,000 with two sureties of the same amount.
