DISPOSED

Holding

The court allowed the anticipatory bail application, granting provisional bail subject to bond and antecedent verification.

Summary

Petitioner Raja Kumar Paswan applied for anticipatory bail fearing arrest in a case under Sections 30(a) and 45 of the Bihar Prohibition and Excise (Amendment) Act for alleged recovery of 30 litres of liquor from another shop. He asserted a clean criminal record, no possession of the liquor, and no connection with the shop owner. The State opposed the bail. The High Court, after hearing both sides, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs.500 with two sureties, subject to verification of his antecedent under Section 482(2) of the B.N.S.S. The order stipulated that if any prior case is discovered, the bail would not be confirmed; otherwise, it would be confirmed immediately.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the circumstances.
  • Whether the petitioner’s claim of a clean antecedent justifies granting bail.
  • Whether conditions under Section 482(2) of the B.N.S.S. can be imposed on anticipatory bail.
