Holding

The Court allowed the anticipatory bail application, granting provisional anticipatory bail subject to verification of the petitioner’s antecedent and conditions under Section 482(2) of the B.N.S.S.

Summary

The petitioner, Chhotu Das, sought anticipatory bail in a case registered under Sections 30(a) and 32(iii) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of liquor from his shop and a motorcycle. He argued that he has a clean antecedent, the liquor was not found in his immediate possession, and that he was implicated due to an inimical relationship with a chowkidar. The State opposed the bail. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs.500 with two sureties, subject to the conditions of Section 482(2) of the B.N.S.S. The order is conditional on verification of the petitioner’s antecedent; if any prior case is found, the bail may be withdrawn, otherwise it will be confirmed.

Issues considered

  • Whether anticipatory bail can be granted in a case involving alleged offences under Sections 30(a) and 32(iii) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner’s clean antecedent and the circumstances of the alleged recovery justify the grant of anticipatory bail.
  • Whether the conditions prescribed under Section 482(2) of the B.N.S.S. are satisfied for provisional anticipatory bail.
