Rustam Yadav @ Rustam KumarversusThe State of Bihar

Holding

The court allowed the anticipatory bail application, granting provisional anticipatory bail subject to bond, sureties and verification of antecedents.

Summary

Rustam Yadav applied for anticipatory bail after learning that he might be arrested in a case under Sections 30(a), 37(c) and 41(i) of the Bihar Prohibition and Excise (Amendment) Act, 2018, alleging recovery of ten litres of liquor from a joint family house. He argued that he has a clean antecedent, the liquor was not in his conscious possession, and a confession made in police custody lacks evidentiary value. The State opposed the bail. The High Court, considering these submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.500 with two sureties and that the trial court verify his criminal antecedent. If any prior case is found, the bail may be cancelled; otherwise, the provisional order will be confirmed. The application was allowed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the circumstances.
  • Whether the recovery of liquor from a joint family house and the absence of possession negate the charge.
  • Whether a confession made in police custody is admissible for bail considerations.
