Provisional anticipatory bail is granted to the petitioner subject to conditions and verification of his criminal antecedent.

Summary

The petitioner, Shivji Ram, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly recovering 45 litres of liquor from a bush on land belonging to another person. He asserted that he has a clean criminal record, was not arrested at the scene, and that the allegation was based on secret information without proper investigation. The State opposed his application for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS. The order also directed the trial court to verify the petitioner’s antecedent; if any prior case is found, the bail may be cancelled, otherwise it will be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 Cr.P.C. in a case under the Bihar Prohibition and Excise Act
