BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioners, subject to payment of the outstanding amount in six installments as per Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioners, former chairman and manager of Jhamta PACS, were accused of embezzling 76.175 metric tons of paddy worth Rs. 17,71,068.75. They claimed the paddy was destroyed by rain, rendering it unfit for conversion, and asserted no intent to misappropriate government funds. After the FIR, they deposited Rs. 5,00,000 and offered to pay the remaining Rs. 15,15,516 in six installments. The State and the Bihar State Food Corporation agreed to allow payment before proceeding. The High Court, considering the nature of the allegation and the petitioners' willingness to settle, granted anticipatory bail under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, subject to the stipulated installment payments and bail bond conditions. The bail order was conditioned on timely deposits, with provision for cancellation if payments were not made.

Issues considered

  • Whether anticipatory bail can be granted in a case of alleged embezzlement of paddy under the Bhartiya Nyaya Sanhita.
  • Whether the court may condition anticipatory bail on the payment of the alleged amount in installments.
  • Interpretation and applicability of Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 in granting anticipatory bail.
