Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner subject to specified bond and conditions.

Summary

The petitioner, Bala Nut, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of 40 litres of liquor recovered from a public place. The petitioner claimed false implication, noting no liquor was found in his possession and that the recovery was from an open area. The State opposed bail, while the petitioner highlighted his custody since 08-12-2025, seven prior criminal antecedents, and alleged non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The court considered the facts, the period of custody, and the lack of direct incriminating evidence against the petitioner. It decided to grant bail, subject to a bond of Rs.15,000 with two sureties and conditions regarding family surety, appearance in court, and non‑tampering with evidence or witnesses.

Issues considered

  • Whether bail should be granted to the accused in a case under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the alleged non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, affects the bail decision.
