The court granted bail to the petitioner subject to bond and surety conditions.
Summary
The petitioner, Yogendra Kumar, was arrested on 17 November 2025 after 90 litres of country-made liquor was recovered from a jute sack in an open area, and he was charged under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner claimed innocence, arguing that the liquor was found in a public place and that no incriminating material was recovered from his possession, while noting his two prior criminal antecedents and the lack of compliance with Section 103 of the BNSS, 2023. The State opposed bail, but the court considered the circumstances, the period of custody already served, and the absence of direct evidence linking the petitioner to the liquor. The court decided to grant bail, imposing a bond of Rs.15,000 with two sureties, one of whom must be a close family member, and requiring the petitioner’s appearance at every trial date. The bail may be cancelled if the petitioner defaults on two consecutive appearances.
Issues considered
- Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act considering the facts of the case, custody period, and prior antecedents.
