Patna High Court

Uday Shankar Kumar @ Uday Shankar PrasadversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to bond, sureties and a monthly maintenance condition.

Summary

The petitioner, Uday Shankar Kumar, sought anticipatory bail fearing arrest in a dowry‑related case (Nauhatta P.S. Case No. 230 of 2025) where he was alleged to have assaulted the victim for dowry. The prosecution charged him under several sections of the Bihar Negotiable Securities Act and the Dowry Prohibition Act. The petitioner argued innocence, lack of specific allegations, and clean antecedents. Relying on the Supreme Court’s guidelines in Arnesh Kumar v. State of Bihar, the Court examined the necessity of arrest and the scope of anticipatory bail under Section 438 CrPC. The Court granted anticipatory bail subject to a cash bond, sureties, compliance with Section 482 of the BNSS, and a condition to pay monthly maintenance to the complainant, noting that the maintenance order is interim pending the family court’s decision. The order also warned that non‑compliance could lead to cancellation of bail.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the CrPC in view of the allegations under the BNSS and Dowry Prohibition Act.
  • Whether the guidelines laid down in Arnesh Kumar v. State of Bihar are applicable to restrain unnecessary arrest.
  • What conditions may be imposed on anticipatory bail, including maintenance payment.
