BAIL GRANTED

Holding

Bail was granted to the petitioner upon furnishing a bond of Rs 10,000 with two sureties.

Summary

Akash Choudhary was arrested in connection with a case alleging that he and a co‑accused assaulted an informant and stole Rs 5,000. The prosecution alleged that the co‑accused Rahul Kumar struck the informant with a brick, while the petitioner denied any involvement in the assault and claimed he was falsely implicated. The petitioner had been in custody since 21 September 2025, had no prior criminal record, and the charge‑sheet had been filed. The State opposed bail, but the court, after considering the facts and submissions, ordered the petitioner’s release on bail upon furnishing a bond of Rs 10,000 with two sureties of the same amount. The order was pronounced by Justice Khatim Reza of the Patna High Court.

Issues considered

  • Whether bail should be granted to the petitioner accused under Sections 126(2), 115(2), 109, 303(1) and 303(3)(5) of the Bhartiya Nyaya Sanhita, 2023.
  • Whether the nature of the alleged offences and the petitioner’s lack of antecedents justify the grant of bail.
