BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

Akshay Kumar Yadav applied for bail in a case (PS No. 255 of 2025) involving offences under Sections 309(6) and 103(1) of the Bhartiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. The incident involved masked gunmen firing inside Shiv Jewellers, resulting in the death of the informant’s husband. The petitioner contended that he was not named in the FIR and was implicated solely on the confessional statement of co‑accused Ankit Kumar Yadav, with no weapons or other material recovered from him. He also highlighted his lack of prior criminal record and that he had been in custody since 27‑09‑2025. The State opposed bail, but the court, after considering the circumstances and the weak evidentiary basis, ordered the petitioner’s release on bail with a bond of Rs.10,000 and two sureties.

Issues considered

  • Whether bail should be granted to the petitioner given the nature of the offences and the reliance solely on a co‑accused’s confessional statement.
  • Whether the absence of material evidence against the petitioner justifies bail.
