Patna High Court

Ranvir Kumar @ Suman Kumar @ MPversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted because the confession of a co-accused is not a sufficient basis for continued detention, subject to strict conditions.

Summary

The petitioner, Ranvir Kumar, was arrested in connection with a robbery and assault case (Shahpur P.S. Case No. 14 of 2025) involving alleged theft of Rs. 19 lakh and assault on a driver. The prosecution’s case relied primarily on the confessional statement of a co-accused, Sampurn Kumar, as the petitioner’s name does not appear in the FIR and no material was recovered from him. The petitioner argued that he was falsely implicated, is a student, and that the confession alone is insufficient to justify continued detention. The State opposed bail, contending the seriousness of the offences under the Bhartiya Nyaya Sanhita, 2023 and the Arms Act. After considering the lack of direct evidence against the petitioner and his cooperation prospects, the court granted bail with a cash bond and several conditions. The order also stipulated attendance requirements and provisions for bail cancellation if the petitioner tampers with evidence or absconds.

Issues considered

  • Whether bail should be granted when the only incriminating material is a co-accused's confessional statement.
  • Whether the petitioner poses a risk of tampering with evidence or fleeing.
  • Whether the conditions imposed are sufficient to safeguard the trial process.
