Patna High Court

Md. Reyaj AlamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to specified conditions.

Summary

The petitioner, Md. Reyaj Alam, was arrested in connection with a case involving the recovery of a motorcycle, a pistol, live cartridges and a mobile phone. He sought bail for offences under Sections 111 and 61(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 25(1‑B)a, 26 and 35 of the Arms Act. The prosecution alleged possession of the arms, while the defence argued that the petitioner had no criminal antecedents, was falsely implicated and that no arms were found in his conscious possession. The court noted the petitioner’s custody since 18‑11‑2025, the lack of prior record and the circumstances of the case, and decided to grant bail. Bail was ordered on a bond of Rs. 15,000 with two sureties, subject to conditions including family surety and mandatory appearance at trial dates.

Issues considered

  • Whether bail should be granted to the petitioner for offences under the Bharatiya Nyaya Sanhita and the Arms Act
  • Whether the petitioner’s lack of antecedents and alleged false implication justify bail despite the recovery of arms
