The court granted provisional anticipatory bail to the petitioner, subject to a bail bond, sureties, and verification of his criminal antecedent.

Summary

The petitioner, Ritesh Vishwakarma, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 for the alleged recovery of 207 litres of liquor from his vehicle. He argued that he had a clean antecedent, was not present at the time of seizure, and was unaware of any misuse of his vehicle by his driver and friend. The State opposed his anticipatory bail application. The High Court, considering these submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs.500 with two sureties, subject to verification of his criminal antecedent under Section 482(2) of the B.N.S.S. The order stipulated that if any antecedent is found, the bail would not be confirmed; otherwise, it would be confirmed forthwith. The application for anticipatory bail was allowed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
  • Whether ownership of the vehicle implicates the petitioner in the alleged offence.
  • What conditions should be imposed for the grant of provisional anticipatory bail.

                   APP for the State.

                                2. Petitioner apprehends his arrest in a case registered

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

that petitioner was not arrested from the spot, as such, nothing

was recovered from his conscious possession and he came to be

implicated based on the fact that he is owner of the seized

vehicle. It is next submitted that no prudent person would use

his own vehicle for committing an occurrence and thus, would

event of his arrest or surrender before the learned Court below

within a period of six weeks, is directed to be released on

provisional anticipatory bail on his furnishing bail-bond in the
