The Court granted regular bail to the petitioner, subject to a bond and sureties.

Summary

The petitioner, Sushil Mishra, was charged under Sections 126(2), 115(2), 118(1), 109 and 352 of the B.N.S. for allegedly assaulting the father of an informant with a knife after a monetary dispute. The petitioner claimed innocence, stating he was also injured in a counter‑case and had no prior criminal record, having been in judicial custody since 26‑10‑2025. The State opposed bail, citing the seriousness of the offences. The Court examined the facts, the nature of the allegations, the petitioner’s custody period, and the absence of any risk of evidence tampering or absconding. It ordered that the petitioner be released on regular bail upon furnishing a bond of Rs.10,000 with two sureties, subject to the satisfaction of the Chief Judicial Magistrate, Saran.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the seriousness of the offences under the B.N.S.
  • Whether there is a likelihood of the petitioner tampering with evidence or absconding.
