The court granted provisional anticipatory bail to the petitioner, subject to a bail bond, sureties, and verification of his antecedents.
Summary
The petitioner sought anticipatory bail in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018, alleging that 26.64 litres of liquor were recovered from his motorcycle but he was not arrested at the spot and had no conscious possession. He argued he had a clean antecedent and was unaware that another person misused his vehicle. The State opposed the bail. The High Court, considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs.500 with two sureties, subject to verification of his criminal antecedents and compliance with Section 482(2) of the B.N.S.S. The order was conditioned that if any antecedent is found, the bail would not be confirmed; otherwise, it would be confirmed forthwith. The application was allowed.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
- Whether the petitioner’s ownership of the vehicle and alleged involvement justify denial of anticipatory bail.
- Whether the conditions prescribed under Section 482(2) of the B.N.S.S. are applicable.
