Patna High Court

Farhan @ Farhan AlamversusThe State of Bihar

DISPOSED

Holding

The court allowed the anticipatory bail application, granting provisional anticipatory bail subject to conditions under Section 438(2) Cr.P.C.

Summary

The petitioner, Farhan Alam, feared arrest in a case registered under Sections 379 and 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016, alleging recovery of three litres of liquor from a motorcycle. He contended that he was not in possession of the liquor, was not the owner of the vehicle, and that the case against him was based solely on a confessional statement of another accused made in police custody, which he argued lacked evidentiary value. The State opposed the anticipatory bail application. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.5,000 with two sureties and conditions under Section 438(2) of the Cr.P.C. The court directed the trial court to verify the petitioner’s criminal antecedents and stipulated that if more than one prior case is found, the bail may be revoked; otherwise, the provisional order will be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the Cr.P.C.
  • Whether the confessional statement of a co-accused made in police custody can form the basis for arrest.
  • Whether the petitioner’s alleged lack of possession and ownership of the seized vehicle negates the charge.
