Patna High Court

Goldy KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner.

Summary

The petitioner, Goldy Kumar, was arrested as the driver of a vehicle from which 314.165 litres of foreign liquor was seized, alleged to be a violation of Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act. He claimed innocence, stating he had no knowledge of the liquor and that no incriminating material linked him to the contraband, and highlighted his clean record and lack of compliance with Section 103 of the BNSS, 2023. The State opposed bail, but the court considered the facts, the duration of his custody since 14‑11‑2025, and the absence of evidence of conscious possession. Consequently, the court granted bail on a bond of Rs.15,000 with two sureties, imposing conditions regarding family surety, regular court appearances, and possible cancellation on default. The order was pronounced by Justice Rudra Prakash Mishra.

Issues considered

  • Whether bail should be granted to the accused under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act, given the circumstances of arrest, lack of incriminating material, and non‑application of Section 103 of the BNSS, 2023.
