Patna High Court

Virchand Ram @ Beerchand RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner on the condition of a Rs. 10,000 bond and two sureties.

Summary

Virchand Ram, husband of a deceased woman, was arrested in connection with offences under Sections 126(2), 115(2), 123, 80(2), 103(1), 61(2) and 3(5) of the B.N.S., 2023. He has been in custody since 20 March 2025 and the charge has already been framed. The petitioner contended that he is innocent and that the deceased had committed suicide by consuming poison, thereby alleging false implication. The learned counsel for the State opposed bail. Considering the length of custody and the lack of substantive evidence linking the petitioner to the alleged offences, the Court ordered his release on bail upon furnishing a bail bond of Rs. 10,000 with two sureties of equal amount.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the charges under the B.N.S., 2023
  • Whether the circumstances of the deceased's suicide constitute a ground for granting bail

Legislation cited
