The High Court allowed anticipatory bail to the petitioner under Section 482(2) of the B.N.S.
Summary
Juli Devi, wife of Guddu Sahani, applied for anticipatory bail in a case registered under multiple sections of the B.N.S. alleging her involvement in an assault arising from a family dispute. She contended that she has a clean antecedent, is a woman, and that the FIR is vague and she has been falsely implicated. The petitioner also relied on the earlier grant of anticipatory bail to Sunita Devi and Ganit Devi in a similar matter, seeking parity. The State opposed the bail. The Court, after considering the petitioner's clean record, the lack of specificity in the allegations and the principle of parity, exercised its inherent power under Section 482(2) of the B.N.S. and ordered bail on a bond of Rs 10,000 with two sureties. The anticipatory bail was thus granted subject to the usual conditions.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under the circumstances
- Whether the allegations in the FIR are specific enough to deny bail
- Whether parity with earlier granted anticipatory bail warrants granting bail
