BAIL GRANTED

Holding

The court granted regular bail to the petitioners upon furnishing the prescribed bond and sureties.

Summary

The petitioners Kundan Kumar, Chandan Kumar and Bipin Kumar were charged under several sections of the Bihar Non‑Statutory (BNS) Act for allegedly attacking a police team that was raiding a river bed to curb illegal sand mining. The informant claimed the accused injured police personnel, and they were identified by local residents and police officials. The petitioners, represented by Ms. Jyoti Kumari, sought regular bail, emphasizing their clean antecedents and pointing to earlier anticipatory bail orders granted to co‑accused Akhilesh Kumar and Raju Kumar. The State, through APP Mr. Chandra Bhushan Prasad, opposed the bail application. After considering the submissions, Justice Satyavrat Verma ordered that the petitioners be released on regular bail upon furnishing a bond of Rs.10,000 each with two sureties, pending trial in Bihta Police Station Case No. 667 of 2025.

Issues considered

  • Whether regular bail should be granted to the petitioners charged under Sections 126(2), 115(2), 109, 324(4), 132, 251(2), 3(5) and 117(2) of the BNS Act.
  • Whether the grant of anticipatory bail to co‑accused in related matters influences the petition for regular bail.
